This Privacy Statement explains how Nutrition Warehouse Pty Ltd ACN 128 438 755 (“NW”) deals with privacy issues in providing products through the Nutrition Warehouse website at www.nutritionwarehouse.com.au (“the Website”).

By using or accessing the Website, you consent to our privacy practices as disclosed in this Privacy Statement.

NW collects personal information about you to:

1. process your order for products or services purchased through the Website (“Products”);
2. arrange postage of Products;
3. contact you in response to a query or feedback from you; and
4. enable more efficient browsing of the Website.

Collection of personal information:

1. In the course of providing Products to you, NW may collect personal information about you, including:

• your name

• your address;

• your email address; and

• your mobile number (terms of service)

• credit or debit card details

2. Credit or debit card details are:

• collected by eway (www.eway.com.au) payment gateway; and

• then automatically removed from NW’s computer system daily

3. To offer Klarna’s payment options, we will pass to Klarna certain aspects of your personal information, such as contact and order details, for Klarna to assess whether you qualify for their payment options and tailor the payment options for you.

4. Usually we collect personal information directly from you, from data you input through the Website, including via:

• the registration form on the Website;

• the sponsorship form on the Website;

Mobile Terms Of Service:

The Nutrition Warehouse mobile message service, including SMS/text messages and WhatsApp messages (the "Service"), is operated by Nutrition Warehouse Pty Ltd (“Nutrition Warehouse”, “we”, or “us”). Your use of the Service constitutes your agreement to these terms and conditions (“Mobile Terms”). We may modify or cancel the Service or any of its features without notice. To the extent permitted by applicable law, we may also modify these Mobile Terms at any time and your continued use of the Service following the effective date of any such changes shall constitute your acceptance of such changes.

By consenting to Nutrition Warehouse’s mobile messaging service, you agree to receive recurring messages from and on behalf of Nutrition Warehouse through your wireless provider to the mobile number you provided, even if your mobile number is registered on any state or federal Do Not Call list. Messages may be sent using an automatic telephone dialling system or other technology. Service-related messages may include updates, alerts, and information (e.g., order updates, account alerts, etc.). Promotional messages may include promotions, specials, and other marketing offers (e.g., cart reminders).

You understand that you do not have to sign up for this program in order to make any purchases, and your consent is not a condition of any purchase with Nutrition Warehouse. Your participation in this program is completely voluntary.

We do not charge for the Service, but you are responsible for all charges and fees associated with messaging imposed by your wireless provider. Message frequency varies. Message and data rates may apply. Check your mobile plan and contact your wireless provider for details. You are solely responsible for all charges related to messages, including charges from your wireless provider.

You may opt-out of the Service at any time.

• To unsubscribe from SMS/text messages, text the single keyword command STOP to NutritionWH or click the unsubscribe link (where available) in any text message to cancel. No further messages will be sent to your mobile device, unless initiated by you.

• To unsubscribe from WhatsApp messages, reply with the single keyword command STOP to the WhatsApp chat.

If you have subscribed to other Nutrition Warehouse mobile message programs and wish to cancel, except where applicable law requires otherwise, you will need to opt out separately from those programs by following the instructions provided in their respective mobile terms.

We may change any short code or telephone number we use to operate the Service at any time and will notify you of these changes. You acknowledge that any messages, including any STOP or HELP requests, you send to a short code or telephone number we have changed may not be received and we will not be responsible for honoring requests made in such messages.

The wireless carriers supported by the Service are not liable for delayed or undelivered messages. You agree to provide us with a valid mobile number. If you get a new mobile number, you will need to sign up for the program with your new number.

To the extent permitted by applicable law, you agree that we will not be liable for failed, delayed, or misdirected delivery of any information sent through the Service, any errors in such information, and/or any action you may or may not take in reliance on the information or Service.

• in providing Products to you;

• to contact you to discuss the Products or orders for Products generally, or in response to a query or feedback from you;

• to forward direct marketing material such as newsletters or special offers.  (You can opt out of receiving direct marketing material and NW does not ever rent, sell or lease customer lists to third parties.); and

• to carry out administrative functions associated with the provision of the Products, such as processing payments.

2. Material posted to the Website by you, including comments to any blog post, will be accessible by members of the general public who visit the Website.

3. Nutrition Warehouse does not sell, distribute or disclose your personal information to third parties, except as permitted by this Privacy Policy or as required by law. 

We may share your personal information with third-party service providers engaged to perform functions on our behalf, such as, but not limited to, payment processing, order fulfilment and customer support. These parties are contractually obligated to handle your information securely and confidentially, and to use it solely for the purpose of providing services to Nutrition Warehouse.
